1. Agreement
These Terms of Service ("Terms") govern your access to and use of SupportGraph.tech and the SupportGraph service (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility and account registration
You must be at least 16 years old to use the Service. When creating an account or joining the waitlist, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Acceptable use
You agree not to:
- Use the Service in violation of applicable laws or regulations.
- Upload or transmit content that is unlawful, infringing, harassing, or that you do not have rights to use.
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its underlying infrastructure.
- Use the Service to send spam, phishing, or otherwise abusive communications to third parties.
- Interfere with the security or integrity of the Service.
4. Customer content
You retain all rights in the content you upload, connect, or otherwise provide to the Service ("Customer Content"). You grant SupportGraph a limited, worldwide, non-exclusive, royalty-free license to host, process, and use Customer Content solely as necessary to provide and improve the Service for your workspace, and to comply with legal obligations. SupportGraph does not use Customer Content to train shared or third-party machine learning models.
5. Intellectual property
SupportGraph, the SupportGraph logo, and all related marks, software, documentation, and content on the website are owned by SupportGraph or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.
6. Fees and beta features
Pricing for paid plans will be communicated before any charges apply. Where the Service or specific features are offered on a beta, early-access, or preview basis, they are provided for evaluation, feedback, and iterative improvement, and may change, be added, or be removed.
7. Third-party services
The Service may interoperate with third-party services (for example, knowledge sources, ticketing tools, scheduling, or analytics). Your use of those services is governed by their own terms. SupportGraph is not responsible for third-party services.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, SupportGraph disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. SupportGraph does not guarantee that the Service will be uninterrupted, error-free, or that any AI-generated output will be accurate or fit for a specific purpose. Outputs should be reviewed by a qualified human before being relied upon.
9. Limitation of liability
To the maximum extent permitted by law, SupportGraph and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. SupportGraph's aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid SupportGraph for the Service in the twelve months preceding the claim, or (b) one hundred United States dollars (US$100).
10. Indemnification
You agree to defend, indemnify, and hold harmless SupportGraph from and against any third-party claims arising out of or related to (a) your Customer Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your violation of any third-party rights.
11. Termination
You may stop using the Service at any time. SupportGraph may suspend or terminate access to the Service for breach of these Terms, security risk, or to comply with legal obligations. On termination, the rights granted to you will cease and you must stop using the Service. Sections that by their nature should survive will survive termination.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which SupportGraph is established, without regard to its conflict of laws rules. Disputes will be resolved exclusively in the competent courts of that jurisdiction, except where local law gives you a non-waivable right to bring a claim in your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the website or by email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
